$30.7 Million Settlement in Massanutten Resort Condemnation

Paul Terpak represented Rockingham County in a complex condemnation proceeding involving the acquisition of the entire water and sewer system serving Massanutten Resort. The taking encompassed all related assets, including treatment facilities, tanks, pumps, and equipment,as well as more than 200 miles of underground piping. The system was owned by a large utility conglomerate operating more than 100 similar systems nationwide and ultimately controlled by a Canadian pension fund.

The team managed every phase of litigation, including valuation, title, and easement issues. A court-ordered inventory revealed additional easements on eight separate properties, requiring the joinder of multiple new parties and extensive coordination among counsel and expert witnesses.

After more than three years of contested proceedings, the matter concluded with a $30.7 million global settlement which was recognized by Virginia Lawyers Weekly as the Top Settlement in Virginia in 2026.
