In a published order, the Supreme Court affirms the judgment of the Court of Appeals for the reasons stated in its published opinion Boyette v. Sprouse, 79 Va. App. 558 (2024). In that opinion, the Court of Appeals decided that the trial court did not abuse its discretion in giving a “sudden emergency” instruction to the jury.
