David Gogal's practice focuses on general civil and commercial litigation with an emphasis on contract disputes, real estate matters, business torts and employment matters. He has substantial experience in state and federal courts and has prosecuted numerous appeals, arguing before the Supreme Court of Virginia and the United States Court of Appeals for the Fourth Circuit. From 1993 to 2006 he participated as a faculty member of the University of Virginia's Trial Advocacy Institute.
Representative Cases:

Prosecuted and defended high tech and other companies in trade secret claims including enjoining theft of electronic intellectual property.

Successfully secured judicial enforcement of access to opposing parties' hard drives and disks to establish theft of intellectual property.

Successfully defended multi-count federal antitrust lawsuit, obtaining summary judgment on all counts, upheld by U.S. Court of Appeals for Fourth Circuit.

Represented distributor in a successful resolution of major multi-party antitrust case brought by retailer in U.S. District Court for the Eastern District of Virginia.

Represented large Northern Virginia law firm in defending a legal malpractice claim ultimately dismissed on appeal to the Virginia Supreme Court of Virginia.

Represented a variety of employees and/or new employers in securing court orders in state and federal court voiding overly broad non-compete agreements.

Drafted and successfully enforced covenants not to compete signed by key former employees.

Served as active local counsel in the Eastern District for law firms in Washington, D.C. and other jurisdictions in complex civil litigation, including a major environmental matter, affecting a Northern Virginia residential community.

Successfully obtained reformation of deed of trust in U.S. Bankruptcy Court, saving title insurance company over a million dollars.

Represented title insurance company in quieting title, resolving boundary disputes, and obtaining title by adverse possession.

Represented Northern Virginia county in several condemnation proceedings.

Represented several clients in complex contract litigation in state and federal court involving contract formation, interpretation and enforcement.

Argued numerous appeals before the Supreme Court of Virginia and the U.S. Court of Appeals for the Fourth Circuit.

Successfully intervened in and retried major real estate case affecting several million dollars worth of residential property, convincing both the trial court and the Supreme Court of Virginia to reverse their earlier decisions.

Represented landowners in land use litigation against local governments, including appeals from the Board of Zoning Appeals.

Obtained relief in excess of $1,500,000 in value in a complex partnership dispute involving breach of fiduciary duty and conversion by a general partner.

Represented both a dissenting stockholder and a corporation in appraisal rights actions under Virginia Stock Corporation Act.

Negotiated, drafted documents for and closed major real estate swap on behalf of major historical association in transaction with National Park Service.
